Acceptance of Terms

BiloChat is operated by Emery Parker, an individual doing business as BiloChat in Illinois, United States ("we," "us," or "our"). By downloading or using the BiloChat mobile application (the "App"), you agree to these Terms of Use, which form a contract between you and us. When you first open the App we ask you to confirm your agreement before you can continue. If you do not agree, please do not use the App.

Where BiloChat Is Available

BiloChat is currently offered only in the United States. We do not target or offer the App to people in other countries, and it is not available on other App Store storefronts. If you use the App from outside the United States, you do so on your own initiative and are responsible for complying with your local law.

Who May Use BiloChat

You must be at least 13 years old to use BiloChat. We ask for your date of birth when you first open the App and will not let you continue if you are under 13.

If you are under 18, you may use BiloChat only with the involvement of a parent or guardian, and they should read these Terms with you. Consistent with the app-store accountability laws in Texas and Utah, we do not enforce these Terms against anyone under 18 who agreed to them without a parent or guardian's consent.

The Service

BiloChat is a language-learning app that helps you learn through bilingual conversations, vocabulary tracking, practice exercises, and AI-assisted coaching. We may update, change, or discontinue features at any time.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.

Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or to harass, abuse, or harm others
• Send content that is illegal, hateful, or infringes the rights of others
• Attempt to reverse-engineer, disrupt, or gain unauthorized access to the App or its systems
• Misuse AI features to generate harmful, deceptive, or abusive content
• Access the AI features through automated means (bots, scripts, or scrapers) or share an account to exceed normal individual use
• Impersonate anyone, or misrepresent your affiliation with a person or organisation
• Use the App if you are barred from doing so under applicable sanctions or export-control laws, or in a country subject to a comprehensive US embargo

There is no tolerance for objectionable content or abusive behaviour. Content that is unlawful, hateful, harassing, threatening, or sexually explicit — and in particular any content that sexualises a minor — is not permitted, and neither is abusive conduct toward other people using the App. We screen messages for the most serious categories automatically, and every report is reviewed. We remove content and terminate accounts that violate this rule, generally without warning. You can report content or block another person from the conversation's Settings screen at any time. Blocking takes effect immediately. We review reports promptly and act on them as quickly as we reasonably can.

Subscriptions & Payments

BiloChat offers auto-renewable subscriptions. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID account settings. Use of the App is also governed by Apple's standard End User License Agreement (EULA):

Refunds. Purchases are made through Apple, so refunds are handled by Apple under its own policies, not by us. You can request one at reportaproblem.apple.com. We cannot issue refunds directly.

Fair use of "unlimited" features. BiloChat Pro is described as offering "unlimited" AI coaching, conversations, and word enrichment. "Unlimited" means there is no per-day usage cap that a person using the App normally would reach — it is not a license for automated, resold, or shared-account use. To keep the service fast and affordable for everyone, we apply reasonable fair-use limits that only guard against automated abuse and are set well above ordinary individual use. We may adjust these safeguards, and we will not use them to restrict genuine personal use of the features your subscription includes.

User Content

You retain ownership of the content you create in the App. You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, and process that content solely to provide and improve the service, as described in our Privacy Policy. This license ends when you delete the content or your account, except for copies held in routine backups until they age out.

You are responsible for the content you send, and you confirm you have the right to send it.

Copyright Complaints

If you believe content in the App infringes your copyright, email support@bilochat.com with: your contact details; identification of the work you say is infringed; identification of the material and where it appears; a statement that you believe in good faith the use is not authorised; a statement that the information is accurate and, under penalty of perjury, that you are authorised to act for the owner; and your signature. We remove infringing material and terminate repeat infringers.

Third-Party Services

Some features depend on services we do not control — Apple (sign-in, payments, on-device translation), Google Firebase (accounts, sync, notifications), Google Gemini (AI features), and RevenueCat (subscriptions). Your use of the AI features must also comply with Google's Generative AI Prohibited Use Policy. We are not responsible for those services' own acts or omissions.

Disclaimers

The App is provided "as is" without warranties of any kind. BiloChat is a learning aid and does not guarantee fluency or specific learning outcomes. AI-generated feedback may contain errors and should not be relied upon as professional translation or instruction.

Limitation of Liability

To the maximum extent permitted by law, BiloChat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the App.

To the maximum extent permitted by law, our total liability to you for all claims arising out of or relating to the App is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) fifty US dollars.

Nothing in these Terms limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, for fraud, or for anything else that applicable consumer-protection law does not permit us to exclude. Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of the two paragraphs above may not apply to you, and you keep any rights your state's consumer-protection law gives you.

Indemnification

You agree to indemnify and hold harmless BiloChat and its operator from claims, damages, and reasonable costs arising from content you send through the App, your breach of these Terms, or your violation of any law or of anyone else's rights. This does not apply to the extent the claim arises from our own acts, and it does not apply where you are a consumer and applicable law does not permit it.

Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time from Account → Settings → Delete Account.

Governing Law and Disputes

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-laws rules. You and we agree that the state and federal courts located in Illinois will have exclusive jurisdiction over any dispute, except that either of us may bring an individual claim in small-claims court where it qualifies.

Nothing here removes any right your own state's consumer-protection law gives you to bring a claim where you live, if that law says so.

Talk to us first. Before starting formal proceedings, please email support@bilochat.com and give us 30 days to resolve it. Most problems are far quicker to fix directly.

Changes to These Terms

We may update these Terms from time to time. For changes that materially affect your rights, we will give you notice in the App or by email before they take effect, and where required we will ask you to agree again. Continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you may delete your account.

General

Severability. If any part of these Terms is found unenforceable, that part is limited or removed to the minimum extent necessary and the rest stays in force.

No waiver. If we do not enforce a provision of these Terms, that is not a waiver of our right to enforce it later.

Assignment. You may not transfer your rights under these Terms without our written consent. We may transfer ours in connection with a merger, acquisition, or sale of the business, on notice to you.

Entire agreement. These Terms and the Privacy Policy, together with Apple's standard EULA, are the whole agreement between you and us about the App, and replace any earlier version.
